RULES OF CONDUCT

Rules of Conduct are mandated by the San Juan County Community Development and Planning office to ensure the use of the property shall be operated in a way that will prevent unreasonable disturbance to the area residents. 

Emergency Contact: In case of a life-threatening or property emergency, call 9-1-1. For all other emergencies on the property or house, please notify the owner agent at the 24-hour contact number posted in your arrival pack.

Bracken Fern Occupancy: The number of overnight occupants is limited to 4 guests, including children at Orcas Island Getaway @ Bracken Fern.

West Sound Occupancy: The number of overnight occupants is limited to 6 guests, including children at Orcas Island Getaway @ West Sound

Rosario Occupancy: The number of overnight occupants is limited to 6 guests, including children at Orcas Island Getaway @ Rosario

Rosario Sea Views Occupancy: The number of overnight occupants is limited to 6 guests, including children at Orcas Island Getaway @ Rosario Sea Views

Bracken Fern Trespass: Trespassing on adjacent or nearby properties is strictly forbidden. Under no conditions should renters disregard a "No Trespassing" or "Private Property" signs. Therefore, the use of the rental is restricted to the property boundaries of the 3/4 +/-  acre parcel at Orcas Island Getaway @ Bracken Fern. The property boundary is as as follows: Bracken Fern Lane on the North, fence line on the East and West side and South boundary of the property is between the south ends of the fence. See boundary map for additional clarifications.

West Sound Trespass: Trespassing on adjacent or nearby properties is strictly forbidden. Under no conditions should renters disregard a "No Trespassing" or "Private Property" signs. Therefore, the use of the rental is restricted to the property boundaries of the 1.75 +/-  acre parcel at Orcas Island Getaway @ West Sound. The property boundary is as as follows: From the parking area, look for the grass areas that are maintained to ensure you are not trespassing. The fenced-in horse areas belong to our neighbor at the barn to the north (with whom we also share the driveway). Please stay within the fenced portion of the back yard, and the mowed/maintained portion of the front/side yards.

Rosario Trespass: Trespassing on adjacent or nearby properties is strictly forbidden. Under no conditions should renters disregard a "No Trespassing" or "Private Property" signs. Therefore, the use of the rental is restricted to the property boundaries of the .64 +/-  acre parcel at Orcas Island Getaway @ Rosario. The property boundary is as as follows: Rosario Road to the North, approx 10' above the ravine hillside on the Northeast and following the property boundary markers from the driveway to the southeast.

Rosario Sea Views Trespass: Trespassing on adjacent or nearby properties is strictly forbidden. Under no conditions should renters disregard a "No Trespassing" or "Private Property" signs. Therefore, the use of the rental is restricted to the property boundaries of the .57 +/-  acre parcel at Orcas Island Getaway @ Rosario Sea Views The property boundary is as as follows: Rosario Road to the South, the edge of the driveway to the North, Power Boxes to East and Fence Post Marker to the West in the treeline.

Water Conservation: We ask guests to be aware of water conservation practices during their visits to the San Juan Islands. Some suggested best practices include:
- run the dishwater with full loads and re-use drinking glasses or refillable water bottles
- turn off the water while brushing your teeth and avoid excessively long showers

Garbage and Recycling: Garbage and recycling containers are located outside the home. Please ensure lids are properly secured to the cans. Crows and Raccoons can cause quite the mess with unsecured containers.

Noise & Quiet Hours: San Juan County has a noise ordinance that limits the level of noise between the hours of 10 PM and 7 AM. Please respect our neighbors in our community when activity is during these hours.

Parking: Parking is limited to the parking spaces located on the property. At no time will renters use parking spaces of adjacent properties or park on the Rosario Road, Enchanted Forest Road or Bracken Fern Lane. Please respect the neighborhood by not using other driveways or private areas for parking or turnaround. Campers and RV's are not allowed to be parked on the property.

Outdoor Burning: Guests must ensure that there is not a burn ban in effect by visiting www.orcasfire.com if the fire-ring is to be used. Additionally, any outdoor fires must be monitored at all times and extinguished when not in use.

TERMS OF RENTING FROM ORCAS ISLAND GETAWAY

Agreement

Orcas Island Getaway, the Agent of the Owners, and Tenant agree as follows: Tenant is at least twenty- five (25) years of age (an “adult”) and will be an occupant of Orcas Island Getaway during the entire reserved dates. In addition to Tenant, other authorized occupants may be family members or friends of Tenant provided through the Registered Guest Profile form submitted from our website at the time of booking. The use of the home and property is not permitted by unauthorized persons. Should any unauthorized persons occupy or use the Premises, Tenant shall vacate the premises immediately without any refund.

Reservations & Deposit

Reservations are subject to the rates in effect at the time said reservations are placed. The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. Late departures causing delay in housekeeping are subject to a $50 per hour fee. 

For reservations more than 180 days (6 months) in advance, a deposit totaling 50% of the agreed upon Total Amount is due with acceptance of rental agreement if requested by guest, otherwise full payment will be made. If reservation is being made within 60 days of arrival date; then full payment is required at the time of reservation. Payment of deposit shall be deemed as acceptance of this rental agreement. Deposit payment must be made using a major credit card or ACH.

Balance & Damage

Balance is due 60 days prior to arrival date and includes either a non-refundable Damage Waiver or a refundable Security/Damage deposit. Payment must be made by major credit card. Personal Checks and Cashiers Checks are not accepted. Damage deposits will be issued within 24 hours of checkout pending inspection by housekeeping and/or agent. Depending on your financial institutions process, it could take up to 7 days to post to accounts. Tenant assumes responsibility for all damages to unit, damages exceeding the damage deposit or damage waiver will be the responsibility of the tenant . If damage is present when tenant checks in, must be notified in writing within 12 hours of arrival. Guests who do not complete their final balance by the 60 day deadline will be contacted to finalize payments. Balance non-payments late will have trips cancelled without refund after 7 days.

Trip Insurance

We highly recommend purchasing travel insurance that will cover your entire trip in the event of unplanned circumstances that force you to cancel or modify your trip. Refunds for cancellations are not issued within 60 days of arrival or during stay (see reservation cancellation & changes below), regardless of circumstance. This includes illness, death, injury, travel disruption and circumstances referred to as “Acts of God”. Below are a few suggested areas to start researching:

Check-in & Check-out Times

Our standard check-in time is 4:00 PM on the date of arrival and at 10:00 AM on the date of departure.

Cancellation Policy

Greater than 60 days:

Should you need to cancel your reservation with more than 60 days notice prior to the arrival date, a cancellation fee of 10% of the reservation amount or $50, whichever is greater, will be charged. All other funds will be refunded in the manner they were received. Please allow between 2 and 7 business days for the funds to appear on your card on file based on financial institutions processes.

Less than 60 days:

Reservations canceled within 60 days of reservation dates are not eligible for a refund for the nightly rates under any circumstance. However the Cleaning Fee and Damage Deposit will be refunded in full.

Changes or Modifications to your existing reservation

In the event your travel plans change and you decide to modify a reservation, the following will apply:

Greater than 60 days until your arrival date:

Should you need to modify your reservation with 60 or more days remaining until your checkin date, a reservation change fee of $50 will be assessed.

Less than 60 days until your arrival date:

If your arrival date is less than 60 days, no modifications or changes are allowed and the reservation is non-refundable.

Issues during your stay

If you are experiencing an issue during the stay, please call us at 213-267-2276 and/or email us at info@orcasislandgetaway.com immediately.

We will attempt to resolve your issues in a timely manner and ensure your stay is a pleasant one. Upon completion of your stay, no compensation shall be provided under any circumstances for issues that arose during the stay.

Failure to contact us at the time you notice the issue, you are in full agreement that the said issues are immaterial and acceptable. Furthermore, the lack of contact indicates full agreement to forfeit future compensation for the inconvenience. If you feel that the issues are severe, please contact 213-267-2276 during your stay so we can resolve or compensate according to our standard compensation schedule.

Inclement Weather

We do not refund rents or deposits lost due to cancelled or shortened stays because of bad weather, impassible roadways, or interruption to ferry or airline service.

Pet Policy

Orcas Island Getaway is a dog-friendly home, however guests must be approved for their pets at the time of reservation inquiry and Pet fee paid in full. Approved pets will be at least 1 year old, spayed or neutered and up-to-date with their vaccinations. If it is brought to our attention that you have/had unauthorized pet(s) without prior agreements approval, you will be required to vacate the property without refund or rate adjustment.

Minimum Age Clause

We require at least one member of the party to be 25 (twenty-five) years of age. 

Falsified Reservations

Any reservation obtained under false pretense will be subject to forfeiture of reservation deposit, damage deposit, and/or balance of rental payment.

Housekeeping/Maid Service

There is not daily maid/housekeeping service during your stay at Orcas Island Getaway. The use of our linens and towels is included, but they are not to be taken from the unit at any time other than beach towels.

Smoking Policy

Smoking is strictly prohibited. A $250 deodorizing fee will be charged to your credit card (above and beyond the standard cleaning fee) if any evidence of smoking is found.

Utilities & service

Orcas Island Getaway will provide water, heat, electric, and weekly trash pickup. No compensation will be given for temporary outage of electricity, gas, water, streaming services, or internet service. Guests should report all outages immediately. All efforts will be made to have them restored as soon as possible.

During your Stay

    •    Upon arrival, report any pre-existing damage immediately.

    •    Please report any damages done during your stay.

    •    Please refer to “Departure” checklist for items to be completed prior to your departure.

Entry to home by owner/agent

Owner or owner’s agents may enter the premises under the following circumstances: in case of an emergency; to make any necessary or agreed upon repairs, alterations, or improvements; supply necessary or agreed upon services or show the premises to prospective purchasers, renters or contractors. Owner will provide renter with at least 24 hours notice of Owners intent to enter (except in the case of an emergency/repair).

Washington State Laws

Tenant and any guest of Tenant shall obey all laws of the state of Washington, as well as local laws, at all times while they are on the premises. Failure to abide by the laws of Washington or the above rules may cause tenant to be asked to vacate the premises and forfeit all rents and security/damage deposits. In the event any legal proceedings take place from either party, the jurisdiction for hearings will be held in San Juan County, Washington.

Capacity, Disturbance to Neighbors and House Rules

Tenant and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the stated sleeping capacity, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts which interferes with neighbors’ right to quiet enjoyment of their premises. Please review House Rules section below for full details.

Exterior Security Camera Notification

Orcas Island Getaway homes are equipped with an exterior security camera.

Hold Harmless

Orcas Island Getaway and/or the property owner, do not assume any liability for loss, damage or injury to persons or their personal property. Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, electricity, internet or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond its control.

Maintenance

Please report any maintenance needs for the premises to us and we will respond as quickly as possible, however the unique geographic location of the home, and a small workforce in skilled labor on the island can cause excess delays. Refunds will not be made for maintenance issues including, but not limited to heating, appliances, televisions, stereos, internet service or hot tub.

Linens, Towels & Supplies

An initial supply of paper products is provided. Extra items needed are the responsibility of the Tenant. Limited cleaning supplies may be provided. We recommend that you bring any special items that you may need during your stay.

Unforeseen occupancy issues, availability & use

It is hereby understood and agreed that should a property be damaged or be deemed uninhabitable due to fire, natural disaster, construction, maintenance or any other unforeseen reasons that another unit may be substituted. If no other unit is available, the limit of liability by Orcas Island Getaway or property owners is to refund any prepaid rents paid by the registered guest for said unit. Further, Orcas Island Getaway accepts no responsibility or liability for any injury, accident or incident that the cause in part or wholly may be attributed to design and/or building construction deficiency(s) with respect to the standards of any building code.

ADDITIONAL TERMS AND CONDITIONS

The undersigned Tenant, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all liabilities, claims, demands, and causes of action by reason of any injury, loss of damage by whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorneys fees and costs. Property owner and Orcas Island Getaway reserve the right to terminate this Agreement upon their discretion at any time.

GUEST may not let, sublet or assign this lease for all or any part of the premises without prior consent from LESSOR.

If GUEST abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.

In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney’s fees as fixed by the Court in addition to all relief at law or equity.

Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.

GUEST assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the GUEST.

When due to circumstances unforeseen or beyond the control of Orcas Island Getaway, the accommodation reserved is not available or not tenantable, for any reason, money paid will be refunded pro-rata or substitute accommodations, if available will be offered at the published rental rate. The responsibility of is expressly, and hereby agreed to be limited to such refund or substitution.

Credit Card Authorization

I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by “clicking” that I have read the terms and conditions of this property, I am bound by this agreement and I have signed “electronically, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not limited to: unauthorized long distance telephone, cable, satellite TV or internet charges, damages beyond normal wear and tear.

Please remember that you are renting a private home. Please treat it with the same respect you would like shown in your own home.

HOT TUB USE

Using any hot tub (no matter who owns it or where it is located) carries with it some serious risks. If your party fails to follow any of the rules we have set forth below, someone in your party could have an allergic reaction, become seriously ill, injured or die. For your own safety and the safety of everyone in your party, it is very important that you, the booking guest, follow and make sure everyone in your party is aware of and follows these rules.

Solo Use: Never use the hot tub/jetted tub/swim spa or pool alone.

Children: Children should be supervised by an adult at all times when using the hot tub/jetted tub/swim spa/pool. Children under 5 years of age may not use the hot tub.

Chemical Dispenser: Never remove the floating chemical dispenser from the hot tub. Dispenser must stay in hot tub at all times in order to promote sanitary conditions. If the floater is empty or low, notify us immediately so it can be refilled.

Medical Conditions:

-People with allergies to bromine/chlorine/water treatment chemicals or have the following medical conditions or susceptibilities must not use the hot tub.

-Persons using any medication for, or anyone with a medical condition including, but not limited to, obesity, heart disease, low or high blood pressure, thyroid disease, multiple sclerosis, diabetes or circulatory system problems unless the person’s treating physician has advised the person that hot tub/jetted tub/swim spa use will be safe.

-Pregnant women and women who may possibly be pregnant. Hot water temperatures have a high potential for causing harm to the fetus during the early months of pregnancy.

-Individuals who have or may have suppressed or weak immune systems.

-Do not use hot tub/jetted tub/swim spa if you have open wounds or infections of any kind.

Contact Lenses: Remove contact lenses before entering the hot tub/jetted tub/swim spa.

Limited Usage: Always exit the hot tub after 15 minutes of use to give your body temperature time to normalize. Prolonged use can cause rashes or infection.

Shower: Always shower before and after using the hot tub

No Alcohol or Drugs: The use of alcohol or drugs in or around the hot tub is extremely dangerous. The combination of hot tub and intoxicants may lead to unconsciousness and the possibility of drowning.

Temperature: Never adjust the temperature of the water in the hot tub/swim spa above 104 degrees. Check water temperatures before entering. It should never exceed 104 degrees. Lower water temperatures are recommended for children.

Submersion: Never allow your head to submerge in hot tub/jetted tub/swim spa. Long hair can become lodged in the intake of hot tub.

Slip & Fall: Be careful not to slip when entering, leaving or using the hot tub. The surrounding area may be slick and wet, including the walkway.

Cover & Lock: The hot tub must always be covered and locked when not in use. This is for the safety of your family and any children in the area. Never let anyone of any age sit or stand on cover – it will not support a person’s weight. A $450.00 charge will result from breakage.

No Electrical Appliances: Do not bring any electrical appliance, such as a light, telephone, radio or television within 15 feet of the hot tub.

Foreign Material: Never use any soaps, oils or fragrance of any type or introduce any other foreign materials in the hot tub. This could cause damage to the equipment and affect the chemical balance of the tub pool and cause a dangerous situation.

Jewelry & Fabrics: Discoloration of certain fabrics may occur in hot tub. Jewelry should never be worn. Permanent damage to jewelry can occur. Bathing suits should not be worn for extended periods after use of hot tub due to the possibility of skin irritation or infections.

Office Notification of Problems or Concerns: If there are any problems with the hot tub, including but not limited to any mechanical, electrical, chemical or water quality concerns, please call the property management office immediately and do not enter the hot tub/jetted tub/swim spa/pool until it has been serviced.

Notification of Security & Recording: Exterior cameras are located at our homes for security purposes which capture both video and audio within the area of the security camera.

No Guarantee: Orcas Island Getaway cannot guarantee, especially after use, that bacteria will remain eliminated by the hot tub chemicals. Should you have any concerns relating to cleanliness please contact us immediately. The cost of cleanings due to failure to follow these rules may be charged to the guest.

Availability: While we try our best to ensure the hot tub is in operable order, there could be times that it is out of service. In the event of such situation, there are no financial reimbursements for non-use of the Hot Tub.

This Privacy Policy governs the manner in which Orcas Island Getaway collects, uses, maintains and discloses information collected from users (each, a "User") of the http://www.orcasislandgetaway.com website ("Site").

Personal identification information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, fill out a form, respond to a survey, and in connection with other activities, services, features or resources we make available on our Site.Users may be asked for, as appropriate, name, email address, mailing address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Web browser cookies

Our Site may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

How we use collected information

Orcas Island Getaway may collect and use Users personal information for the following purposes:

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. Electronic newsletters

If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

Third party websites

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Advertising

Ads appearing on our site may be delivered to Users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile non personal identification information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This privacy policy does not cover the use of cookies by any advertisers.

Google Adsense

Some of the ads may be served by Google. Google's use of the DART cookie enables it to serve ads to Users based on their visit to our Site and other sites on the Internet. DART uses "non personally identifiable information" and does NOT track personal information about you, such as your name, email address, physical address, etc. You may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy at http://www.google.com/privacy_ads.html

Compliance with children's online privacy protection act

Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our Site from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.

Orcas Island Getaway has the discretion to update this privacy policy at any time. When we do, we will post a notification on the main page of our Site. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your acceptance of these terms
